Hoffman Memorial Lecture: Firearms, Mental Illness, and the Law: Keeping Guns From Risky People While Keeping Faith With the Second Amendment
The U.S. Supreme Court’s decisions in Heller (2008) and McDonald (2010) clarified that the limited function of law in preventing gun violence in America is not gun control but people control — not to restrict firearms in the population, but rather to keep guns out of the hands of particularly dangerous individuals. What is the best way to do that? This lecture describes how research evidence can be used to advance a risk-based framework for firearms restriction — a practical, nondiscriminatory approach that fairly balances risk and rights. Dr. Jeffrey Swanson is professor in psychiatry and behavioral sciences at Duke University School of Medicine. Swanson’s research is focused on building evidence for policies and laws to prevent firearm violence and to improve outcomes for adults with serious mental illnesses in the community. He is currently principal investigator of a multi-state study on firearms laws, mental illness and prevention of gun violence, co-sponsored by the National Science Foundation, the Brain and Behavior Foundation, and the Robert Wood Johnson Foundation's Program on Public Health Law Research.
